Tender Phase: Part 2
The contracting authorities are obliged to provide additional explanations regarding the tender documentation on or through the public procurement portal no later than four days before the end of the deadline for receiving offers, provided that the request was submitted in time.
The contracting authorities are obliged to provide additional explanations regarding the tender documentation on or through the public procurement portal.
Amendment of the publication of the contract (third paragraph of Article 74 of the ZJN-3).
The contracting authority must always ensure the public opening of bids (which takes place automatically in the e-JN system), except
in cases where ZJN-3 defines an exception to the implementation of the public opening of bids. In the case of two-phase procedures, the opening of applications is not public.
The opening of bids must not take place earlier than one hour after the deadline for submission of bids.
The record of the opening can be generated for the bidder in the form of a document and contains automatic display of information about the names of the bidders who submitted the bid, information on whether it is a variant bid (if applicable) and the total bid value of each individual bid.
The contracting authority publishes a notice concerning additional information or information about an incomplete procedure when it amends or supplements the tender documentation, or when it terminates the public procurement procedure or rejects all bids because all received bids are late, incorrect, unsuitable, unacceptable, or formally incomplete.
The contracting authority submits a public contract after verifying that the offer complies with the requirements and conditions specified in the public contract notice and in the documentation related to the public contract award.
If the information provided by economic operators (bidders) appears incomplete or incorrect, or if specific documents are missing, the contracting authority may request that the economic operators submit the missing documents within a specified deadline or provide clarifications, corrections, or explanations to the relevant information or documentation. Such requests must be fully compliant with the principles of equal treatment and transparency.
Checking of certificates (certificate database) and checking of all required elements (checking of social elements - e.g. e-Dosje, AJPES).
If the contracting authority chooses a contract of low value and negotiations, only the client must announce or mark it in the tender documentation, in the publication of the public procurement notice and in the e-JN electronic tender submission system.
The expert committee consists of the holder of the procurement and other experts in the field of the subject of the order.
The contracting authority must make a decision on the public procurement within 90 days from the deadline for submission of bids.
It is possible to stop the procedure until the deadline for submission of offers. The contracting authority can reject all bids at all stages of the procedure after the deadline for opening bids has expired.
